Terms & Conditions
1. Agreement to these terms
By using our website, submitting a booking request, messaging us, paying a deposit, or receiving services at Diamond Tip Tattoo, you agree to these Terms & Conditions and our Privacy Policy.
If you do not agree, do not use the website or book services.
2. Our services
We provide custom tattooing, related consultations, body piercing (where offered), aftercare retail, and related studio services in Dapto NSW.
We are appointment-focused. Walk-ins are not guaranteed. Artists, styles and availability may change.
3. Age & identification
- Tattoos: You must be 18+ and present valid government photo ID before work begins.
- Piercing: Age and consent rules will be confirmed at booking; ID may be required.
- We may refuse service if ID is not provided, appears invalid, or we reasonably believe legal requirements are not met.
4. Bookings & consultations
Website consultation requests are enquiries, not a confirmed appointment, until we confirm in writing (email, Messenger, SMS or similar) and any required deposit is paid.
Consultations are generally free and non-binding. Quotes may be estimates until design size, placement and session length are finalised.
Preferred dates/times on the form are requests only.
5. Deposits, pricing & payment
- Session deposits (when requested) reserve your appointment time and artist preparation.
- Deposit amount, what it covers, and whether it is credited to the final price will be confirmed in writing before payment.
- Final price depends on size, detail, placement, sessions and artist rates discussed with you.
- Payment methods accepted will be advised by the studio (cash/card/transfer as offered).
- Custom design preparation may start after deposit; see Refund Policy for cancellations.
6. Cancellations, rescheduling & lateness
Please give as much notice as possible if you cannot attend.
- Reschedule: We will try to move your booking subject to availability.
- Late arrival: We may shorten or reschedule your session so other clients are not delayed.
- No-show: Failure to attend without notice may result in loss of deposit as set out in the Refund Policy, except where the Australian Consumer Law requires otherwise.
- Studio cancellation: If we cancel, we will reschedule or refund any unused deposit for that session.
7. Designs & intellectual property
- Custom artwork created by our artists remains the intellectual property of the artist/studio unless otherwise agreed in writing.
- You receive the tattoo as applied to your body; that does not automatically transfer copyright in the design drawings.
- We may refuse designs that infringe others’ rights, promote hate, or are otherwise inappropriate.
- Reference images you provide should be ones you have the right to use for inspiration.
8. Health disclosure, risks & aftercare
Tattooing and piercing involve inherent risks (including pain, bleeding, infection, allergic reaction, scarring, and dissatisfaction with healed results if aftercare is poor).
- You must disclose relevant health information that may affect safety (allergies, conditions, medications, pregnancy, etc.).
- We may refuse or postpone work for health & safety reasons.
- You agree to follow aftercare instructions provided. Healing varies by person.
- Tattoos are permanent. Removal or cover-up is a separate service and not included unless agreed.
Aftercare overview is also available on the website; your artist’s instructions take priority for your piece.
9. Touch-ups
Where aftercare has been reasonably followed, we may offer a complimentary touch-up within a stated period (commonly within 6 months) as a studio goodwill policy — details confirmed with your artist.
Touch-ups are not a substitute for ACL remedies where a consumer guarantee failure applies. Neglect of aftercare, sun damage, weight change, or intentional alteration may void goodwill touch-up offers.
10. Studio shop & pickup orders
Online shop orders (where enabled) are for studio pickup unless we expressly offer delivery. Payment at studio may apply (“pay at studio” orders).
- Product availability can change; we may contact you to adjust or cancel lines.
- Collect within the timeframe we advise or we may restock items.
- Retail returns are covered in the Refund Policy.
11. Studio conduct
We provide a professional, private environment. We may refuse or end a session if a person is intoxicated, abusive, unsafe, or breaches hygiene rules. Deposits may be handled under the Refund Policy depending on circumstances.
12. Photos & social media
We will not use identifiable photos/videos of you for marketing without your consent via our Media Release or equivalent written/clear consent.
You may decline marketing use and still receive services.
13. Website, try-on tools & messaging
- Website content is general information; it is not medical advice.
- “See it on you” / try-on tools are approximate previews only — final tattoos differ.
- Messenger and form tools may share your enquiry with studio systems as described in the Privacy Policy.
- We aim for uptime but do not guarantee uninterrupted website access.
14. Australian Consumer Law (important)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with services, you may be entitled to cancel and receive a refund for the unused portion, or similar remedies. For minor failures, we may provide a remedy by repairing/resupplying the service.
These Terms do not exclude, restrict or modify those non-excludable rights. Where we can limit liability for goods/services not of a kind ordinarily acquired for personal/domestic use, we may limit liability to resupplying the service or paying the cost of resupply, to the extent permitted by law.

15. Liability (to the extent permitted by law)
To the maximum extent permitted by law, and subject always to the ACL:
- We are not liable for healing outcomes caused by failure to follow aftercare, third-party interference, or unrelated medical conditions not disclosed to us.
- We are not liable for indirect or consequential loss (such as lost wages for a session you miss), except where the ACL or other law says we cannot exclude that liability.
16. Governing law
These Terms are governed by the laws of New South Wales, Australia. Courts of NSW (and Commonwealth courts as applicable) may hear disputes, without limiting any rights you have to use fair trading conciliation services.
